This Privacy Policy (Policy) explains how MVMNT collects, uses, shares, and protects information in connection with the Service.
Important:
The Service includes blockchain-based features. Some information (including Wallet addresses and on-chain transaction data) may be publicly visible and cannot be deleted by us.
1) Scope
This Policy applies when you visit or use the Service, connect a Wallet, buy or sell items, participate in donations, interact with Tokens, submit Content, or contact us through in-Service forms.
This Policy does not cover third-party services (wallets, blockchains, RPC providers, exchanges, payment processors, shipping carriers, etc.). Those third parties have their own privacy practices.
1-1) Capitalized Terms and Related Policies
Capitalized terms not defined in this Policy have the meanings given to them in the Terms of Service. This Policy should be read together with the Terms of Service and the Copyright and Intellectual Property Policy (DMCA Compatible). If there is a conflict between this Policy and the Terms of Service regarding how personal information is handled, this Policy governs.
2) High-Level Summary
- Non-custodial: we do not control your private keys.
- On-chain transparency: blockchain data may be public and irreversible.
- Form-based contact: you contact us through in-Service forms.
- Risk-based verification: we may collect KYC information primarily for high-value sales and high-risk activity.
- Donations: receipts are issued by Beneficiaries; we may share donor details with Beneficiaries where necessary.
3) Information We Collect
3-1) Information You Provide
We may collect information you provide, such as profile details (optional); order and fulfillment details (for Physical Items and POD Items); Seller and shop information and Listing details; donation-related details (including information needed for acknowledgements or receipts, if applicable); communications submitted via in-Service forms; and KYC information when required.
3-2) Automatically Collected Information
We may collect device and network data (for example IP address, browser type, OS), usage logs, and cookie identifiers.
3-3) Blockchain and On-Chain Information
We may process Wallet addresses, transaction hashes, token and NFT contract addresses, token IDs, timestamps, and other publicly visible blockchain metadata.
3-4) Information From Third Parties
We may receive information from service providers such as wallet connectors, blockchain infrastructure providers, analytics and security vendors, KYC providers (when verification is required), and fulfillment partners.
4) How We Use Information
We use information to provide and operate the Service; fulfill orders; support donation-linked features; prevent fraud, illegal goods, and policy violations; provide support via forms; analyze and improve the Service; and generate internal indicators and metrics (currently intended for internal use).
5) Legal Bases for Processing
Where required, we process personal data based on contract necessity, legitimate interests, legal obligations, and consent (where applicable).
6) Identity Verification (KYC)
6-1) When We May Require KYC
We may require identity verification primarily to reduce the risk of illegal goods sales, fraud, and other high-risk activity, especially in connection with high-value commerce.
We may require KYC for selling items above a High-Value Threshold disclosed in the Service; elevated risk signals or suspected prohibited items; and legal or marketplace integrity reasons.
6-2) What We Collect
If required, we may collect identity and verification information and may use third-party verification providers.
6-3) If You Do Not Complete KYC
If KYC is requested and not completed, we may restrict access to certain features.
7) Donations and Beneficiaries
7-1) Beneficiary Approval
Beneficiaries are approved through a whitelist process.
7-2) Donation Receipts
Donation acknowledgements or tax receipts are issued by Beneficiaries, not by MVMNT. Tax deductibility depends on the Beneficiary and your jurisdiction.
7-3) Sharing With Beneficiaries
To support donation-linked features and donation receipts (where applicable), we may share donor information with the relevant Beneficiary, including donor identity and contact details (if required), donation amount, timestamps, and transaction identifiers.
7-4) Timing, Fees, and Mechanisms
Holding periods, distribution timing, direct donation fees, token-related donation mechanisms, batching, and related details may be disclosed in the Service and may change over time.
8) Cookies and Similar Technologies
We use cookies and similar technologies for essential functions, preferences, analytics, and security. You may manage cookies through browser settings and, where available, Service settings.
9) How We Share Information
We may share information with service providers; with Sellers for fulfillment; with Beneficiaries for acknowledgements and receipts; for legal and safety reasons; and in connection with business transfers.
10) On-Chain Data and Deletion Limitations
We cannot delete or alter on-chain records. We will honor valid requests to delete or anonymize off-chain data when feasible and legally permitted.
11) Data Retention
We retain information as reasonably necessary to provide the Service, maintain records, enforce the Policies, comply with legal obligations, and resolve disputes. On-chain data may persist indefinitely.
12) Security
We use reasonable safeguards, but no system is completely secure. You are responsible for securing your Wallet and devices.
13) International Data Transfers
Information may be processed and stored in countries other than where you live. We use appropriate safeguards where required by law.
14) Your Rights and Choices
Depending on your location, you may have rights to access, correct, delete (off-chain), restrict, or object to certain processing. You may opt out of marketing communications where applicable through settings in the Service (if available) or by submitting a request via in-Service contact forms.
15) Children
The Service is not intended for children. You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.
16) Changes to This Policy
We may update this Policy from time to time and may provide notice through the Service.
